Latest News: 6/06/10: The juggernaut of the late government has rolled over us!!

 
 

After over 4 years of uncovering significant issues with Prudential’s mega depot plans and forcing considerable changes and additional planning conditions, the fight is now over.
 

The outcome of the Judicial Review was that the Judge ruled against our case, quoting numerous precedent cases that gave the Secretary of State a wide discretion.
 

The Judge overruled our case that the Secretary of State’s decision to approve a non-compliant planning application, prevented an application coming forward that would not impact on the strategic gap nor the rural character of the area; one that would be less harmful.
 

Continuing as they have throughout the campaign, Prudential and Astral Developments (now Prologis) have been contemptuous of local opinion and to add insult to injury they attempted to recover their costs from SPLAT. The judge refused the Prudential’s request – at least there was some justice!
 

We would like to express our public thanks to our legal team of Paul Stinchcombe, barrister and Louise Humphreys, solicitor (of local firm Peyto Law) who have professionally and compassionately advised and served our cause. We also wish to thank everyone who has supported us in whatever way they have through this long campaign. With your help and support we did win the Public Inquiry (against some of the UK’s leading experts) and we did inject additional conditions into the planning approval, but the juggernaut of the late government rolled over us!!
 

We can only hope this new government lives up to its promise of giving more power back to the community.
 

In addition, we:

  • Uncovered the Prudential’s desire to build Britain’s Biggest Building: a 1,250,000 square foot mega shed at Pyestock, as published in this The Sunday Times article. The mega shed was over twice the size of largest shed in their submitted planning application and the Pru were forced to limit the maximum mega shed size and re-submit their plan
     

  • Challenged the Pru’s maximum daily HGV movements and noise assessments, resulting in the limiting the maximum HGV movements and provision of noise barriers
     

  • Highlighted local, regional and national sustainability objectives being undermined by the proposed massive ‘road only’ mega depot at Pyestock. The mega depot should be appropriately located to accommodate rail freight. It would then save over 35 million HGV road kilometres per annum
     

  • Obtained local and national media coverage whilst challenging the Prudential’s misleading planning applications and public statements, causing alterations to their plan
     

  • Raised awareness and galvanising public opinion with over 12,500 objections (un-precedented in our local area) as a result we gained local Council support, which was previously recommending the approval of significantly less protective conditions
